§ 1

GENERAL PROVISIONS

The Controller of personal data collected via the website http://www.toptextil.pl is TOPTEXTIL Sp. z o.o., with address of main business activities and correspondence address: ul. Mickiewicza 29, 34-100 Wadowice, KRS: 0000203447, NIP: 6792798257, REGON: 356824053 e-mail: info@toptextil.pl, hereinafter referred to as the Controller.

§ 2

PURPOSE AND SCOPE OF INFORMATION COLLECTION

Personal data collected via this website will be used for the purpose of providing a service (sales of fabrics) and direct marketing concerning the company’s products and services realised in the traditional manner which are the legitimate business interest of the company. Data are processed in this respect on the basis of Article 6 para. 1b, 1c, and 1f of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
After consent has been expressed in the understanding of Article 6 para 1a of the GDPR, data may also be processed for the purpose of sending commercial information by electronic means or for making phone calls for the purpose of direct marketing, as understood by Article 10 para. 2 of the Law on provision of services by electronic means dated 18 July 2002 or Article 172 para. 1 of the Telecommunications Law dated 16 July 2004, including phone calls made as a result of profiling operations providing that the user has given the relevant consent.

Personal data processed for the purpose of realisation of the service (agency in real estate sales) will be processed for the period of time essential for the realisation of the service, after which data which are subject to archivisation will be stored for the period of time relevant to the expiration of any potential claims, i.e. 10 years. Personal data processed for marketing purposes covered by express consent will be processed until this consent is withdrawn.
If it is determined that the processing of personal data violates the provisions of the GDPR, the person whom the data concern is entitled to lodge a complaint with the Inspector General for the Protection of Personal Data (after 25 May 2018 – the President of the Personal Data Protection Office).

Provision of personal data is entirely voluntary. Personal data will also be processed in an automatic manner in the form of profiling provided the user has given consent for this as understood by Article 6 para. 1a of the GDPR. Such profiling will result in a profile being attached to a given individual in order to take decisions regarding this individual, and also to analyse or predict this individual’s preferences, behaviours, and attitudes.

The Data Controller shall make every effort to protect the interests of those affected by the data, and in particular shall ensure that the data collected are: collected in compliance with the law, collected for clearly specified legal purposes and not processed further for purposes not in compliance with these initial purposes, substantially correct and appropriate to the purposes for which they are processed, and stored in a manner which allows the identification of the persons which they concern, for a period not longer than that which is essential for achieving the purposes of their processing.

RIGHT TO ACCESS, CONTROL, AND CORRECT THE CONTENT OF PERSONAL DATA

The person whom the personal data concerns has the right to access the content of their personal data, and to correct, delete, or restrict processing, the right to transfer data, lodge a complaint, and withdraw consent for processing at any time without affecting the legality of processing which took place before withdrawal of consent.

The Data Controller’s website uses cookies. Failure to change the user’s browser settings is synonymous with consent for the use of cookies.

Use of cookies is necessary for the proper provision of services on the website. Cookies files contain information essential for the proper functioning of the website, in particular those which require authorisation.

The website www.toptextil.pl uses three types of cookies: session cookies, persistent cookies, and analytical cookies.
Session cookies are temporary files which are stored on the end user’s device until the user logs out (or leaves the page).
Persistent cookies are stored on the end user’s device for a period defined in the parameters of the file or until they are deleted by the user.

Analytical cookies allow the manner in which the user interacts with the content of the page to be better understood, to improve the organisation of the page. Analytical cookies collect information on the way the user makes use of the page, on the kind of page from which the user was referred, on the number of unique visits, and on the time spent by the user on the page. FINAL PROVISIONS

The Data Controller shall use all technical and organisational means to ensure the security of personal data adequate to the threat and category of data concerned, in particular to ensure the prevention of access by unauthorised parties, theft by unauthorised parties, processing in violation of relevant legislation, and alteration, loss, damage, or destruction.

The Data Controller shall employ appropriate technical means to prevent acquisition or modification by unauthorised parties of data sent by electronic means.

In matters not covered by this Privacy Policy, the relevant regulations of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and other applicable provisions of Polish law.

The provision of this Privacy Policy are effective as of 25 May 2018.
